About Peliku

These Terms of Use and Sale (“Terms”) govern access to and use of the Peliku service, available notably at peliku.com and app.peliku.com, as well as subscriptions to paid plans offered by Hoody Studio.

By creating an account or using Peliku, you agree to these Terms.

Peliku is an application designed to help creators, teams and professionals organize their content production.

Depending on the features and plan used, Peliku may notably allow users to:

• organize ideas, content, scripts, notes, tasks, calendars and workflows;
• collaborate within workspaces;
• store files directly in Peliku;
• use files from external services such as Google Drive or Dropbox;
• connect Instagram, TikTok, YouTube, Twitch or other compatible accounts;
• prepare, publish and schedule content on certain platforms;
• view certain statistics from connected platforms;
• manage contacts and certain information related to content creation activities.

Available features may evolve as Peliku develops.

Account Creation and Security

Using Peliku requires the creation of an account.

Users agree to provide accurate information and to keep their information up to date where necessary.

Users are responsible for maintaining the confidentiality of their credentials and for the use of their account.

Any activity carried out through an account is presumed to have been performed by the account holder or by a person they have authorized, unless proven otherwise.

If unauthorized access is suspected, the user should change their credentials and contact Peliku where necessary.

Personal and Team Workspaces

Each user may have a personal workspace and, depending on their plan and permissions, participate in shared workspaces.

Team workspaces may include different roles, including Owner, Admin, Editor and Viewer.

These roles determine the actions each member may perform.

Workspace owners and administrators are responsible for managing members, invitations and permissions.

When a user leaves a workspace, they lose access to the data belonging to that workspace. Their departure does not automatically delete content belonging to the workspace.

Certain operations, including transfer of ownership, may be required before an Owner can leave a workspace or delete their account.

Responsibilities of Workspace Members

Users should invite only people whom they genuinely wish to grant access to their workspace.

Depending on their role, members may be able to view, create, modify or prepare content and files.

Peliku implements permission and data-isolation mechanisms, but workspace owners remain responsible for the permissions they grant to collaborators.

File Storage in Peliku

Peliku allows video, image and audio files to be stored directly within the service.

Files are hosted using storage infrastructure used by Peliku and are accessed through secure mechanisms.

This limit may change for technical or commercial reasons.

Storage quotas depend on the plan used.

As of the date of these Terms:

• Free trial: 10 GB;
• Creator: 80 GB;
• Team: 150 GB;
• Enterprise: 500 GB.

The current quotas and characteristics of each plan are those displayed in Peliku or on the pricing page at the time of subscription.

Google Drive and Dropbox Files

Peliku also allows users to work with files from external services such as Google Drive and Dropbox.

When an external file is only referenced within Peliku, it remains hosted by its original provider and does not consume Peliku storage.

Its availability may depend on:

• the third-party service;
• permissions granted;
• sharing settings;
• continued connection to the service;
• the continued existence of the file at the provider.

If the user explicitly chooses to import the file into Peliku, a copy becomes a file stored by Peliku and counts towards the applicable storage quota.

Additional Storage

Certain eligible plans may allow users to voluntarily activate additional storage beyond their included quota.

Before activation, Peliku displays the applicable price and the main billing conditions.

Additional storage is measured according to the volume actually stored and the duration for which it is retained, expressed in GB-months.

A free allowance may apply under the conditions displayed in Peliku.

The applicable rate is the rate displayed and accepted by the user at the time the feature is activated.

Billing is processed through Stripe.

Users may deactivate additional storage according to the options available in Peliku. Deactivation does not cancel charges corresponding to storage already used.

Storage Reservations and Uploads in Progress

While a file is being uploaded, Peliku may temporarily reserve the required storage capacity in order to prevent simultaneous uploads from exceeding the available quota.

An incomplete file or an upload that has failed is not considered a finalized stored file.

Technical reservations may be automatically released following cancellation, failure or expiration of an upload.

Voluntary File Deletion

A user with the necessary permissions may permanently delete a file stored in Peliku.

Once finalized, this deletion is immediate and irreversible.

Files voluntarily deleted in this manner are not moved to Peliku's general Trash.

When a file is used in one or more pieces of content, Peliku may warn the user before deletion.

Deleting a file may remove its references from content with which it was associated.

The content itself is not deleted solely because an associated file has been deleted.

Retention After Subscription Ends

When access to storage genuinely ends following the termination of a subscription or another applicable access right, the relevant files are retained for 30 days.

During this period, access may be restricted, but users may notably be able to retrieve their files through the features provided by Peliku.

If the user regains valid access before the end of this period, including through a new subscription, the scheduled deletion is cancelled.

At the end of the 30-day period, the relevant files are permanently deleted.

Users are responsible for retrieving any files they wish to keep before this deadline.

Third-Party Services and Accounts

Peliku may connect to third-party services including:

• Instagram / Meta;
• TikTok;
• YouTube / Google;
• Twitch;
• Google Drive;
• Dropbox.

Use of these services is also subject to their own terms and policies.

Peliku does not control their availability, APIs, publishing rules or decisions made by these platforms.

Changes, suspension or discontinuation of an API or third-party account may therefore affect certain Peliku features.

Social Connections in Team Workspaces

A social account connected within a workspace functionally belongs to that workspace.

Depending on permissions configured in Peliku, authorized members may use that connection to prepare or perform actions on the connected account.

Passwords and technical tokens used to access third-party platforms are not disclosed to other workspace members.

A user connecting an account to a workspace must have the necessary authority to allow that account to be used within the workspace.

Publishing to Social Networks

Where the feature is available and authorized by the user, Peliku may directly publish content to certain connected platforms.

The user remains responsible for:

• the content published;
• the selected account;
• captions, titles, hashtags and other information submitted;
• rights relating to videos, images, audio, music or other materials used;
• compliance with the destination platform's rules;
• compliance with applicable law.

Peliku does not systematically perform prior editorial review of publications.

Scheduled Publications

Peliku may allow users to schedule a publication for a specific date and time.

Scheduling depends notably on:

• continued connection to the platform;
• availability of its API;
• validity of the permissions granted;
• availability of the relevant file;
• rules of the destination platform.

Peliku implements mechanisms intended to execute scheduled publications and report their status, but cannot guarantee that a third-party platform will always accept or publish content at the requested time.

Users should verify the status of their publications where this is important to their activities.

Statistics from Connected Platforms

Peliku may retrieve and display certain statistics provided by connected platforms, including views, interactions, followers or other metrics.

These statistics depend entirely on the data made available by the relevant platforms.

Peliku does not guarantee their completeness or permanent availability.

User Content

Users retain ownership of the content they create or import into Peliku.

Users grant Peliku only the technical rights necessary to store, process, display, transmit or publish that content in order to provide the requested features.

Peliku does not claim ownership of users' creations.

Users warrant that they have the necessary rights to use the content they process through Peliku.

Prohibited Uses

Peliku must not be used to:

• store or publish illegal content;
• infringe the rights of third parties;
• violate intellectual property rights;
• distribute malware;
• circumvent security mechanisms;
• attempt to access another user's data without authorization;
• misuse infrastructure or APIs;
• engage in spam or fraudulent activities;
• intentionally disrupt the operation of the service.

Peliku may suspend or restrict access where use of the service creates a risk for Peliku, its users or third parties.

Contacts and Third-Party Data

Certain features allow users to store contact details or professional information relating to third parties.

Users are responsible for ensuring that they have a lawful basis for collecting and using such information.

They must comply with applicable personal data protection requirements.

Service Availability

Peliku is provided as an online service.

Hoody Studio uses reasonable efforts to ensure its availability and security.

Interruptions may nevertheless occur, including as a result of:

• maintenance;
• updates;
• technical incidents;
• infrastructure failures;
• third-party services;
• API changes;
• force majeure events.

Changes to the Service

Peliku is an evolving service.

Features may be added, modified, replaced or removed in order to improve the product, respond to technical or regulatory requirements, or reflect changes to third-party services.

Where a change materially affects an essential feature of a paid plan, Peliku may notify the users concerned.

Plans and Subscriptions

Peliku offers different plans, including Creator, Team and Enterprise.

The applicable features, limits, number of members, storage capacity and prices are those presented at the time of subscription.

Certain plans or benefits may also be granted as part of a partnership, promotion or other specific commercial arrangement.

Free Trial

Peliku may offer a free trial period.

The trial currently includes a storage quota of 10 GB.

At the end of the trial, certain features may become unavailable or accessible only in read-only mode until a compatible paid plan is activated.

The availability and conditions of the free trial may evolve.

Prices

Applicable prices are those displayed when subscribing to a plan or activating a paid feature.

Where required by law, prices are displayed inclusive of applicable taxes.

Taxes may be determined based on billing information and applicable tax rules.

Payment

Payments are processed by Stripe.

Peliku does not store full payment card numbers.

Users must maintain a valid payment method where their plan or an activated feature requires payment.

Renewal

Unless otherwise stated, recurring subscriptions renew automatically at the end of each billing period until cancelled.

The amount charged upon renewal corresponds to the applicable plan and pricing conditions, subject to any advance notice required by law.

Cancellation

Users may cancel their subscription through the features provided in Peliku or according to the instructions available in their account.

Unless otherwise provided or required in a particular situation, cancellation takes effect at the end of the period already paid for.

Access remains available until the effective end date according to the conditions of the relevant plan.

The effective end of storage access triggers the retention period described in Section 10.

Failed or Unsuccessful Payments

If a payment fails, Peliku may temporarily maintain certain access rights during a payment recovery period.

If the situation is not resolved, access to paid features may be suspended or terminated.

Data is not immediately deleted solely because a payment has failed.

When access effectively ends, the applicable retention rules take effect.

Refunds

Amounts already charged are non-refundable except where required by applicable law or where a specific provision offered by Peliku provides otherwise.

This provision does not limit any mandatory rights available to consumers.

Enterprise Plan and Additional Members

The Enterprise plan may include a certain number of members.

Additional members may be billed according to the conditions displayed in Peliku or agreed with the customer.

The exact conditions depend on the subscribed plan.

Partnerships and Benefits

Peliku may grant certain partners specific benefits, including a free plan or discount, for the duration specified in their partnership agreement.

Termination of a partnership may result in the end of that benefit without deleting the history of the partnership, commissions or payments.

The partner remains free to subscribe to an available Peliku plan afterwards.

Conditions relating to commissions, promotional codes and payments may be governed by a separate agreement.

Partner Program

Where a user participates in the Peliku Partner Program, the specific terms agreed for that partnership supplement these Terms.

Commissions are calculated according to the rate and rules applicable to the relevant agreement.

Payments may be made according to the periods and procedures agreed between Peliku and the partner.

Liability

Peliku uses reasonable efforts to ensure the operation of the service, retention of data in accordance with the stated rules and execution of requested actions.

Peliku cannot, however, be held responsible for failures directly attributable to a third-party platform, external interruption, incorrect configuration of a user's account or content rejected by a platform.

To the extent permitted by law, Hoody Studio shall not be liable for indirect damages such as loss of business, loss of opportunity or loss of revenue resulting from use of the service.

Nothing in these Terms limits any liability that cannot legally be excluded or limited.

The processing of personal data is described in the Peliku Privacy Policy.

Account Deletion

Users may request permanent deletion of their account from Peliku.

Certain situations must be resolved before deletion, including where the user is the last person responsible for a shared workspace containing other members or where a transfer of data or responsibility is required.

Deletion results in the deletion of the relevant data in accordance with the rules described in the Privacy Policy.

Certain information may be retained where required by legal, tax or accounting obligations or for the establishment, exercise or defence of legal claims.

Governing Law

These Terms are governed by French law.

Mandatory consumer protection rules remain applicable where relevant.

In the event of a dispute, the parties are encouraged to seek an amicable solution first.

Failing this, disputes shall be subject to the competent courts in accordance with applicable legal rules.

Consumer Mediation and Dispute Resolution

If you experience any difficulty concerning the use of Peliku or the application of these Terms, please contact us first at:

We will seek, where possible, to resolve the matter amicably.

Where applicable under French consumer law, a consumer may, after first submitting a complaint to Peliku and where no satisfactory resolution has been reached, use a consumer mediation service free of charge.

For professional users, disputes shall be submitted to the competent courts in accordance with applicable law, subject to any valid jurisdiction clause agreed between the parties.

Severability

If any provision of these Terms is found to be invalid, void or unenforceable, the remaining provisions shall remain in effect.

Where possible, the affected provision shall be interpreted or replaced in a manner that preserves its original purpose while complying with applicable law.

No Waiver

Failure by Hoody Studio to exercise or immediately enforce any right or provision under these Terms does not constitute a waiver of that right or provision.

Changes to these Terms

Peliku evolves regularly.

These Terms may therefore be amended to reflect, among other things:

• new features;
• changes to plans or prices;
• changes to third-party services;
• technical developments;
• new legal or regulatory requirements.

The applicable version is the version published on the Peliku website and identified by its last updated date.

Where changes are significant and materially affect users' rights or obligations, Peliku may notify affected users by an appropriate means before the changes take effect where required.

Continued use of the service after the new Terms take effect constitutes acceptance of those Terms to the extent permitted by applicable law.

Related Contractual Documents and Policies

These Terms should be read together with the other documents applicable to Peliku, including:

• the Privacy Policy;
• the Cookie Policy;
• the Legal Notice;
• pricing information and any specific terms presented when subscribing to a plan or activating a paid feature.

In the event of any conflict between a general provision of these Terms and specific terms expressly accepted when subscribing to a plan or activating a paid feature, the specific terms shall prevail with respect to the relevant matter, to the extent permitted by applicable law.

Entry into Force

These Terms enter into force on the date of their publication.
